California Students with Disabilities Can Enroll in Independent Study, Judge Rules

Some students with disabilities had been shut out of school this year because independent study was not part of their learning plans. The U.S. District Court for the Northern District of California ordered the State of California to make sure that fifteen students with disabilities are provided with meaningful access to remote instruction, special education services, and contact with other students.

The judge agreed that California's AB 130 is likely against the Americans with Disabilities Act by not allowing remote learning as a reasonable accommodation to students with Individualized Education Programs who are at greater risk of exposure to and severe outcomes from COVID-19. Legal action for students in similar situations across the state is ongoing.
