Court Rules That a Temporary Impairment Can Qualify as a “Disability” Under the ADA

The U.S. Court of Appeals for the Ninth Circuit ruled that an employee’s temporary impairment can qualify as a disability under the Americans with Disabilities Act (ADA). The Ninth Circuit’s decision covers an important question under federal disability law and could lead to a big change in how employers are required to deal with employees’ short-term medical limitations. It is clear from the Court's opinion that employers can't just dismiss an employee’s request for an accommodation simply because the impairment is temporary.
