NEW Guidance on Opioid Use Disorder and the Americans with Disabilities Act

The U.S. Department of Justice published new guidance on opioid use disorder (OUD) and the Americans with Disabilities Act (ADA). The document, “The Americans with Disabilities Act and the Opioid Crisis: Combating Discrimination Against People in Treatment or Recovery,” talks about the protections available to people with OUD under the ADA and provides guidance to entities covered by the ADA about how to follow the law. It discusses topics including when OUD is considered a disability, the protections available to individuals taking legally prescribed medication to treat their OUD, and how to file a complaint if individuals believe they have been discriminated against because of their OUD.
